Terms and conditions

Article 1: Definitions

For the purposes of these General Terms of Use and Sale (hereinafter the "GTUS"), each of the terms below, whether used in the singular or the plural, has the meaning given in the following definition:

  1. Beneficiary

Means the User or, where applicable, the person attending an Event holding a valid Ticket;

  1. Ticket

Means the printout, the electronic document, or any electronic process evidencing the transaction carried out between the Organiser and the User through the Platform and giving the latter the right to access an Event;

  1. CNDP

Means the National Commission for the Control of the Protection of Personal Data;

  1. Order

Means the act of ordering a Ticket on the Platform by a User;

  1. Publisher

Means the publisher of the Platform, namely ELECTRONIC EVENTS, a single-shareholder limited liability company with a share capital of 100,000 dirhams, whose registered office is at 4 Rue Abdelouahab Azzaqqaq Etg No. 1 Appt No. 1 Belvedere - Casablanca, registered with the Casablanca trade register under number 403217 and with tax identification number 25254268.

  1. Event

Means a show, a sporting event, a music concert or any cultural, sporting or leisure gathering organised by an Organiser;

  1. Submitted Information

Means any information entered by the User on the Platform;

  1. Organiser

Means any person organising an Event and offering the related Tickets for sale on the Platform;

  1. Platform

Means the "events.ma" platform, the subject of these terms;

  1. User

Means any person using the Platform, including account holders and, where applicable, those placing an Order.

Article 2: Purpose

"events.ma" is a commercial intermediation website that connects a User and an Organiser and allows the latter to offer Tickets for sale on the Platform.

These general terms apply to every Ticket purchase made through the Platform. The Publisher acts as an intermediary at the sales stage but never takes part in organising the Event. The Organisers are therefore fully responsible for how the Event runs.

These general terms therefore do not cover the running of the Event itself. Organisers may add their own conditions regarding the Event in a document shown to the User when the Order is placed.

Article 3: Ticket prices

Ticket prices are shown in Moroccan dirhams, all taxes included.

Since Organisers are entitled to change the various prices during the sales period, invoicing by the Publisher is based on the prices in force at the time the User creates the Order.

Article 4: Creating an account

When placing a first Order, each User must first create an account on the Platform. Creating the account requires entering the personal details needed to identify the User. A username and a password are assigned to the User. The User must take every precaution required to prevent unauthorised persons from using the account fraudulently.

For subsequent Orders, the User must sign in to the account assigned to them.

Article 5: Availability and choice of seats

The Platform tells the User, in real time, which Tickets are available while an Order is being created. If some Tickets stop being available between the start and the end of an Order, the system informs the User. The User may then check the contents of the Order before confirming and paying.

Unless stated otherwise when the Order is created and on the Ticket, seating is unallocated at the Event. If the Organiser has chosen to set up a seat selection system, the User is invited to choose a seat or an area during the Order creation process. The location shown on a map or a diagram is indicative. It aims to be as representative as possible but has no contractual value.

The Organiser and the Publisher also reserve the right to limit the number of Tickets each User may order.

Article 6: Payment

Confirming an Order carries the obligation to pay the price shown. Only one payment method is allowed per Order.

  1. 6.1 - Payment by bank card

An Order may be paid for with a valid bank card. That payment is handled by our banking partner, the Centre Monétique Interbancaire (CMI). Its contact details are available from the web page https://www.cmi.co.ma/.

Once the transaction has been approved by our banking partner, the User's bank account is debited by the amount of the Order. At the end of the transaction, an Order confirmation is sent to the User by email.

If a payment turns out to be invalid according to our banking partner after a Ticket has been issued, that Ticket is invalidated and will therefore not give access to the Event.

Exchanges with the Platform are secured. The User's bank details are not stored by our system. Online electronic payments are made on the Platform through the page dedicated to our banking partner, which secures them using appropriate encryption and authentication technologies.

  1. 6.2 - Alternative payment

Where payment is allowed through channels other than those offered by our banking partner, the Platform will place the User's Order on hold. Once payment has been made within 12 hours and confirmed by the Organiser to the Publisher, the Order will be sent to the User by email in the manner set out in Article 7 below. After that 12-hour period, the reservation is cancelled automatically.

Article 7: Order confirmation

As soon as payment is made, a confirmation message is sent immediately to the User's email address.

  • Following confirmation of the Order by the User, the Publisher or, where applicable, the Organiser will send the User the Ticket, which will show the following details:
    • The User's first and last name and, where applicable, those of the Beneficiary;
    • The name, date and place of the Event;
    • The identity of the Organiser;
    • The price paid by the User;
    • The unique identification number linked to the Ticket and the Order, and a barcode.
  • It is then the User's responsibility to check that the Ticket has been received correctly, along with its nature and the details shown on it, and, in the event of an error, to raise objections by notifying the Publisher within:
    • no more than 72 hours; or
    • if that deadline would fall after the date of the Event, it is reduced to 6 hours.

The User must take every precaution required to prevent fraudulent and unauthorised use of the Ticket by third parties. Furthermore, no duplicate other than the original Ticket will be issued, including in the event of loss or theft.

Note that some email providers may delay message delivery. If the Ticket has not arrived after several hours, the User is invited to contact the Publisher's customer service. Not receiving the Ticket does not make the Order invalid.

Article 8: Conditions for presenting Tickets at Events

Before attending the Event, the User must print the Ticket on A4 paper. To be accepted, the Ticket must be complete and clearly legible; damaged or illegible Tickets will be treated as invalid.

Presenting a Ticket on a digital device (for example a smartphone) will only be accepted if the Organiser expressly says so in the information shown on the Ticket.

The Publisher accepts no liability for any anomaly that may occur while an Order is placed, or while a Ticket is downloaded or printed.

Article 9: Special conditions for the use and presentation of Tickets

A Ticket may only be used once to enter an Event. Accordingly, in the event of loss, theft or duplication, only the first person to present the Ticket will be admitted to the Event. A holder of an already-used Ticket has no claim to any refund. Reproducing, duplicating or counterfeiting Tickets is prohibited.

The Ticket is only valid for the place, date and time it belongs to. The Ticket must be kept until the end of the Event.

Access to the Event may be name-bound, according to the conditions set by the Organiser and stated when the Order is created, in the Order confirmation email and on the Ticket. In that case, in addition to the User's identity, the Beneficiary's identity will be shown on the Ticket. The Beneficiary must then present, along with the Ticket, valid photo identification at the entrance to the Event venue matching the name printed on the Ticket. Name-bound Tickets remain personal and non-transferable, unless the Organiser gives express prior authorisation.

Only the Organiser is entitled to refuse access to the Event venue. No refund will be granted in that case.

The Organiser is free to check the validity of Tickets on entry to the Event. The Organiser is not required to check the identity of the Ticket's Beneficiary, since the Ticket carries a unique identification number and a barcode. The User and the Beneficiary must therefore keep their Tickets confidential. The Organiser is not required to check that the Ticket is genuine.

Article 10: Refund and cancellation of an Event

Under article 42 of Law No. 31-08 setting out consumer protection measures, Tickets are not subject to a right of withdrawal. Every Order is therefore legally treated as firm and final.

  • A Ticket cannot be refunded, even in the event of loss or theft, nor taken back, nor exchanged. Only the following cases may give rise to a refund:
    • If the Event is cancelled or substantially altered;
    • If the Organiser authorises the refund and makes the funds available to pay it.

It being understood that any decision to cancel, postpone or alter an Event is entirely the Organiser's responsibility.

In the cases set out above, the refund will only be made to the User and will only cover the price of the Ticket. No additional charge of any kind will be refunded or compensated. No refund request will be considered if it is made more than 7 days after the date the Event was cancelled.

When the cancellation of an Event, or a change to its date, time or place, is announced and an Order has been placed for it, the User expressly authorises the Publisher, as far as possible and once the Organiser has itself informed the Publisher, to use the information entered by the User to keep them informed of the steps to follow.

In any event, the User is invited to check 24 hours before the date of the Event that it is still going ahead unchanged.

Article 11: Customer service

For any query from the User about the Event or the conditions of access, the User must contact the Organiser directly, whose contact details are on the Ticket sales page. If the query cannot be resolved, the Organiser will contact the Publisher.

For any technical query about access to the Platform and receipt of the Ticket after Order confirmation, the User may contact the Publisher at the email address: [email protected]

Article 12: Liability
  1. 12.1 Liability of the User

The User is solely responsible for the completeness and accuracy of the Submitted Information. The User undertakes to check that it contains nothing liable to infringe a third party's rights or to breach rules of public policy. Under no circumstances may the User's content be untruthful, inaccurate or misleading.

The User is moreover solely liable if a third party's bank card is used.

  1. 12.2 Liability of the Publisher

The Publisher undertakes to use every necessary means to ensure that the User can make good use of the Platform. It uses its best efforts to keep the Platform available 24 hours a day, 7 days a week, apart from scheduled maintenance and subject to the provisions of these terms.

  • The Publisher nevertheless accepts no liability in the event:
    • Of access to an Event being refused by an Organiser;
    • Of the postponement or cancellation of an Event decided by an Organiser or by the authorities;
    • Of a User entering a Beneficiary's personal data without that person's consent;
    • Of interruptions, breakdowns, changes or malfunctions in the use of the Platform, whatever their origin and source;
    • Of being unable to access the Platform because of technical problems, whatever their origin and source;
    • Of direct or indirect damage caused to the User, of whatever kind, resulting from the content of the information and/or from access to, management of, use of, exploitation of, malfunction of and/or interruption of the Platform;
    • Of abnormal use or unlawful exploitation of the Platform by any User;
    • Of a computer attack or hack, or of the loss, removal or blocking, whether temporary or permanent and for whatever cause, of access to the internet.
  • The Publisher's liability may under no circumstances be engaged following any damage, error or shortcoming where the alleged non-performance or poor performance results from:
    • A fault, negligence, omission or failure by the User;
    • Late communication of information by the User or by the Organiser;
    • Of fraudulent use of the authentication credentials given to the User;
    • Failure to follow the Publisher's recommendations;
    • A fault, negligence or omission by a third party over which the Publisher has no power of supervision;
    • In the event of force majeure.

The User therefore waives any claim against the Publisher, on any basis whatsoever, for damage such as losses originating in or resulting from the performance of these terms.

Every User is solely liable for damage caused to third parties and for the consequences of any claims or actions that may follow. The User waives any recourse against the Publisher in the event of proceedings brought against the Publisher by a third party arising from the unlawful use or exploitation of the Platform, in the event a User loses their password, or in the event of identity theft.

The Publisher cannot be held liable for how the Event runs or for the Organiser's performance of its obligations during the Event. As the Event takes place under the sole responsibility of the Organiser, the Publisher cannot be held liable on grounds such as the cancellation, postponement or alteration of the Event or any other incident that may occur during the Event.

Article 13: Personal data

The information needed to create the User's account and to process the Order by the Publisher is: last name, first name, telephone number, postal and email addresses and, where applicable, the User's identity document number. It may also be used by the Publisher to contact you if there is a problem processing your Order.

The Publisher reserves the right to collect data about the User, in particular through the use of cookies. The collection of data by the Publisher, as data controller, is necessary to handle the User's requests.

Further information may be collected at the Organiser's request. The Publisher collects that data on behalf of the Organiser and passes it on. The Organiser is then responsible for properly keeping and using the data it has been given access to.

The Publisher uses every means to ensure the confidentiality and security of the Submitted Information. The personal information collected is used only by the Publisher, the Organiser and, where applicable, authorised third parties.

By accepting these General Terms of Use and Sale, the User expressly authorises the Publisher to pass their personal data to the Organiser. The Publisher cannot be held liable for how that data may be used. The Organiser is solely responsible for managing and for the content it sends to the User.

Under Law No. 09-08, promulgated by Dahir 1-09-15 of 18 February 2009, on the protection of individuals with regard to the processing of personal data, the Publisher undertakes to protect the User’s personal data and informs the User of their right to access, rectify and object to the processing of information concerning them, which may be exercised by writing to: Email: [email protected]

This processing has been notified and is going through the authorisation procedure with the CNDP.

Article 14: Cookies

The User is informed that, when visiting the Platform, a cookie may be installed automatically in their browser and kept temporarily in memory on their hard drive. A cookie is an item that does not identify the User but is used to record information about how they browse the Platform. This information is used partly to improve the security of the Platform and to provide the best possible service.

The User acknowledges having been informed of this practice and expressly authorises its use, without objection or reservation.

Article 15: Governing law

The Platform and the terms and conditions of its use are governed by Moroccan law, regardless of where it is used and where the Event is held. In the event of a dispute, and after any attempt to reach an amicable solution has failed within thirty (30) days from the date the dispute arose, the Moroccan courts alone have jurisdiction to hear it.

Article 16: Acceptance of the General Terms of Use and Sale

The User declares that they have read and accepted these General Terms of Use and Sale as well as any conditions set by the Organiser regarding the running of the Event.

The Publisher reserves the right to change these General Terms of Use and Sale at any time by publishing a new version of them on the Platform. Those changes take effect as soon as they are published on the Platform and are therefore binding on every User from that moment.

In general, any use of the Platform constitutes full acceptance of and unreserved consent to the General Terms of Use and Sale and to any new conditions.

The connection and transaction data kept by the Platform constitutes evidence.
